For the purposes of this contract ‘La Finca del Castillo Arabe’ is a wholly owned trading name of Casa Amelia SL. As such any reference to ‘La Finca del Castillo Arabe’ should be thus considered as reference to Casa Amelia SL for legal purposes.

If you make a booking with La Finca del Castillo Arabe, a binding contract will come into existence when we issue and send you a written confirmation of booking. Your contract with us will be governed by Spanish law and subject to the jurisdiction of the Spanish courts of law. The contract is made with the person named on the Confirmation of Booking, who must be over 18, and who is deemed responsible for informing all members of the party about all matters relating to the booking.

Bookings will be confirmed on receipt of the appropriate deposit payment (or faxed or e-mailed proof of bank transfer thereof). Upon receipt of the appropriate deposit payment, a Confirmation of Booking will be issued by La Finca del Castillo Arabe detailing the total cost of the booking, the amount paid and how much remains to be paid (final payment).
The final payment must be paid four weeks before commencement of the holiday. If it is not paid on time we reserve the right to cancel the booking, retain the deposit and apply cancellation charges as described below.

We will absorb the the first 2% of any cost increase caused by currency fluctuations or taxation rate changes, including IVA (VAT), but thereafter a surcharge may be made. If the surcharge represents more than 5% of the holiday price then you may cancel and receive a full refund of all monies paid.

Any cancellation must be notified to us in writing (this includes e-mail) by the person who has contracted the holiday. If such notification is received more than 28 days before the holiday commencement date, only the deposit will be retained by us. Otherwise the following charges apply, which are based on the expenses and charges suffered by us as a result of cancellation: 21-28 days before, 50%; 15-21 days before 75%; 14 days or less, 100%.
Please note that we very strongly recommend that all members of the holiday party obtain appropriate travel and personal insurance cover.
It may very occasionally be necessary for La Finca del Castillo Arabe to cancel bookings. In such an event we will refund all monies paid in full.

If you wish to alter or amend the booking, we will always do our best to comply with the request. However, changes of dates of bookings may be treated as cancellations and such amendments may be subject to additional charges. Occasionally a change may have to be made by us to confirmed arrangements after a booking has been made. If a major change becomes necessary which we consider could seriously affect the enjoyment of the holiday, we will give you the option of accepting the changed arrangements or a cancellation of the booking with full refund of all monies paid.

Under no circumstances may more than the maximum number of persons (including children) as stated in the accommodation description occupy the property, except by prior written agreement with us. Failure to observe this condition is deemed to constitute a cancellation of the booking by you and La Finca del Castillo Arabe. We reserve the right to refuse admittance or terminate the booking and apply the appropriate cancellation charges.

La Finca del Castillo Arabe undertakes to fulfil the Clients’ requirements as laid out in a final agreed quotation (produced by La Finca del Castillo Arabe) that contains all agreed details
Acceptance of the quotation by the Clients should be by no later than one month from the date of the quotation.
The Clients are required to pay a deposit of 30% of the Food menus plus 30% of the total of Other Costs* at the time of acceptance of the quotation
The Clients are required to pay a stage payment of 20% of the Food menus plus 20% of the total of Other Costs *
Final guest numbers should be confirmed by e-mail no later than two weeks before the event together with remaining costs i.e. 50% of Food plus 50% of total Other Costs*.
Clients are required to pay any subsequent additional costs by cash at the close of the event.
Other costs includes items such as for example;  hire of furniture and equipment, flowers, lanterns.

We have taken all reasonable measures to make sure that the holidays offered on this web site have been properly arranged and that the suppliers of the services included maintain reasonable standards. However, La Finca del Castillo Arabe acts only as an agent and cannot be held responsible for the actions of carriers, providers or organisers of activities and courses. We are specifically not responsible for events outside our reasonable control or if there has been no fault by La Finca del Castillo Arabe. Nevertheless, we will always endeavour to immediately rectify any cause for dissatisfaction during your stay whenever you notify us (see “Complaints” below).
The client is responsible for any area of La Finca del Castillo Arabe occupied and is expected to take reasonable care of it and to leave it in a clean and tidy condition. Any damages are the responsibility of the client and their cost shall be refundable on demand. If the property occupied is left in an unreasonable state and requires extra cleaning, we reserve the right to charge you that cost.

A security deposit is required for the rent of children’s equipment. We reserve the right to deduct any related charges from this deposit if items are broken or need to be replaced. Otherwise the deposit will be refunded in full within three weeks after the end of the holiday. You are asked to kindly replace breakages prior to departure.

While personal insurance for accident, illness and injury is highly recommended, European Union nationals please note that national health service is provided to them free in Spain. You should bring with you an “E111” form for each member of the party to be able to legally claim this service. In the UK this form is available from Post Office.

We do not wish to have dissatisfied customers but in the event that you are not entirely satisfied with the services offered, you should contact us in the first instance. This will give us the opportunity to put matters right during your stay. If the problem cannot be resolved during the holiday period, the client should contact us in writing within 14 days of returning from your holiday and we will do our best to resolve the matter.

We cannot be held liable to accept responsibility for death, bodily injury or illness on holiday unless it is proved that it is due to the negligence of ourselves or our employees and brought to our attention with three months of your return from holiday.

These terms and conditions of contract and all matters arising therefrom, are subject to Spanish Law and to the jurisdiction of the Spanish courts.
